1. Acceptance of Terms

By accessing or using the MARSYS website, framework, documentation, and related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

These Terms constitute a legally binding agreement between you and MARSYS (“we”, “our”, or “us”), a company registered in Switzerland.

2. Description of Services

MARSYS provides a multi-agent AI orchestration platform consisting of:

• MARSYS Framework: An open-source Python library licensed under Apache 2.0 for building and orchestrating multi-agent AI workflows.
• MARSYS Documentation: Technical guides and API references available at marsys.ai/framework.
• MARSYS Website: The informational website at marsys.ai.

Additional services such as MARSYS Studio and MARSYS Cloud are planned for future release and will be subject to supplementary terms when available.

3. User Accounts

Certain features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access to your account.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of applicable laws.
• Attempt to gain unauthorised access to the Services, other accounts, or underlying systems.
• Interfere with or disrupt the integrity or performance of the Services.
• Transmit viruses, malware, or other harmful code through the Services.
• Reverse-engineer any proprietary component of the Services (excluding the open-source framework, which is governed by its own licence).

5. Intellectual Property

The MARSYS framework is released under the Apache License 2.0. All other content on the website — including text, graphics, logos, and software — is the property of MARSYS and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works of our proprietary content without our prior written consent.

6. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure, or that defects will be corrected.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MARSYS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED SWISS FRANCS (CHF 100) OR THE AMOUNTS PAID BY YOU TO MARSYS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Switzerland.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last Updated” date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
